WawaCloud Inc. (operating as "WawaNode" (哇哇), "we," "us," or "our") operates an international VPS and server hosting business (website: https://wawanode.com). WawaCloud Inc. is a Canadian federal corporation incorporated under the Canada Business Corporations Act (CBCA), with its registered office in the Province of Ontario, Canada. "WawaNode" (哇哇) is the operating brand of WawaCloud Inc., and WawaCloud Inc. is the legal contracting party that provides the Services to you. This Privacy Policy explains how we collect, use, share, and protect your personal information, and the rights you have with respect to that information.

WawaCloud Inc. is the controller of your personal data. For business customers, a separate Data Processing Agreement (DPA) applies. This Policy should be read together with our Terms of Service, Acceptable Use Policy, Cookie Policy, Refund Policy, and other applicable policies.

1. Overview and Scope

This Policy applies to the processing of personal information when you visit https://wawanode.com, register for and use our VPS, server, and related hosting services (collectively, the "Services"), interact with our customer support or ticket system, or otherwise engage with WawaCloud Inc. (operating as WawaNode).

This Policy does not apply to third-party websites or services, even where links to them appear within our Services. Please review the respective privacy policies of any such third party before using their services.

2. Information We Collect

We collect information only to the extent necessary to provide and operate the Services, comply with legal obligations, or rely on another lawful basis. This includes:

  • Account information: username, login email, password (stored in encrypted/hashed form), account preferences, and language and interface settings.
  • Identity and contact information: to meet compliance, anti-fraud, and certain jurisdictional regulatory requirements, we may collect your name, contact phone number, country/region, and, where applicable, real-name verification information.
  • Billing and payment information: order records, invoices, selected plans, transaction amounts (priced in CNY), and payment status. Payments are completed through Alipay, WeChat Pay, cards, and USDT; we do not store your full card number or third-party payment account credentials, and such sensitive payment data is handled by the payment processors.
  • Service usage and traffic logs: records of instance creation, modification, reinstallation, renewal, and expiry; resource usage (CPU, memory, storage, bandwidth/traffic); and network traffic metadata retained for operational and compliance purposes.
  • IP address and device information: the IP address (IPv4 / IPv6) used when accessing the dashboard or making requests, browser type, operating system, device identifiers, and approximate geolocation.
  • Cookies and local storage: cookies and browser local storage data used for session maintenance, security, preferences, and analytics, as described in our Cookie Policy.
  • Support and ticket content: the content, attachments, and records of your communications with us via tickets, email, or other channels.

3. How We Collect Information

  • Provided directly by you: when you register, place an order, complete identity verification, submit a ticket, or communicate with us.
  • Collected automatically: when you use the Services, through logs, cookies, and similar technologies.
  • From third-party sources: necessary information obtained from payment processors, anti-fraud services, infrastructure providers, and regulatory/public databases, to the extent permitted by law.

4. How We Use Information

We use the information we collect for the following purposes:

  1. To create and manage your account, and to provision, configure, maintain, and terminate the Services;
  2. To process orders, collect payment, issue invoices, and manage renewals and refunds;
  3. To provide customer support, respond to tickets, and handle inquiries and complaints;
  4. To safeguard the security of our platform and network, and to detect and prevent fraud, abuse, and attacks;
  5. To monitor service availability and performance, and for operations, troubleshooting, and capacity planning;
  6. To comply with applicable laws, regulations, regulatory requirements, and lawful government/judicial requests;
  7. To send you service notices and, where we have obtained the necessary consent or have a lawful basis, marketing communications;
  8. To improve and develop our products, features, and service experience.

5. Lawful Bases for Processing

Depending on applicable law, the lawful bases on which we process your personal information include:

  • Performance of a contract: where necessary to provide and perform the service contract with you;
  • Legal obligation: to comply with applicable legal, accounting, tax, and regulatory requirements;
  • Legitimate interests: for legitimate interests such as ensuring security, preventing abuse and fraud, and improving the Services, where not overridden by your rights and freedoms;
  • Consent: where consent is required by law (e.g., certain cookies, marketing communications), processing is based on your consent, which you may withdraw at any time.

6. Information Sharing and Disclosure

We do not sell your personal information. We share or disclose information, only to the extent necessary, in the following circumstances:

  • Payment processors: we share with the relevant payment processors the information necessary to complete transactions.
  • Infrastructure and upstream providers: we share information necessary to operate the Services with providers such as data centers, upstream network/cloud resources, email delivery, and anti-fraud and security services, subject to contractual confidentiality and security obligations.
  • Legal and regulatory requirements: we disclose information where required by law or to respond to lawful government, regulatory, or judicial requests, or to protect the rights, property, and safety of WawaCloud Inc. and others.
  • Business transfers: in connection with a merger, acquisition, reorganization, or sale of assets, your information may be transferred as part of the transaction, provided the recipient remains bound by protections equivalent to those in this Policy.

7. Data Retention

We retain your personal information only for as long as necessary to fulfill the purposes described in this Policy. Specific retention periods depend on the type of information and applicable legal requirements:

  • Account and service records are retained for the duration of your account;
  • Billing, invoice, and transaction records are retained as required by tax and accounting regulations (typically for several years);
  • Security and traffic logs are retained for a limited period as needed for operations and compliance;
  • When there is no longer a reasonable need to retain information, we will delete or anonymize it.

8. Data Security

We implement technical and organizational measures appropriate to the risk to protect your personal information, including encryption in transit (TLS), hashed password storage, access controls and least-privilege principles, network isolation and protection, log auditing, and periodic security assessments. Nevertheless, no method of internet transmission or storage is completely secure. If a security incident affecting your personal information occurs, we will respond promptly in accordance with the law and notify you where required.

To the extent permitted by applicable law, you have the following rights regarding your personal information:

  • Erasure: to request deletion of your personal information where conditions are met;

  • Withdrawal of consent: to withdraw consent previously given, without affecting the lawfulness of processing before withdrawal.

We use cookies and browser local storage to maintain sessions, ensure security, remember preferences, and perform analytics. You can manage or delete cookies through your browser settings, although some features may be limited as a result.

11. Cross-Border Data Transfers

WawaNode provides international hosting services, and your personal information may be transferred to and stored on servers or with providers located outside your country/region (including in Canada). When making such cross-border transfers, we apply appropriate safeguards in accordance with applicable law to ensure your information receives a level of protection consistent with this Policy.

12. Minors

Our Services are intended for adults or persons with full legal capacity and are not directed at minors. We do not knowingly collect personal information from minors. If we become aware that we have collected information from a minor without appropriate consent, we will delete it as soon as possible.

13. Third-Party Links

Our Services may contain links to third-party websites or services. These third parties have their own independent privacy policies, and we are not responsible for their content or privacy practices. Please review their privacy policies before use.

14. Governing Law and Dispute Resolution

This Policy and our processing of your personal information are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules.
