1. Overview
This Acceptable Use Policy (the "Policy") sets out the rules you must follow when using the website, cloud servers, VPS, dedicated servers, IP addresses, bandwidth, network, storage, control panel, technical support, and other related services provided by WawaCloud Inc. (operating as "WawaNode", "we", "us", or "our"). WawaCloud Inc. is the legal contracting party that provides the service; "WawaNode" is its operating brand and the name of its website, platform, and service.
This Policy forms part of the Terms of Service and, together with the Privacy Policy, Refund Policy, Service Level Agreement (SLA), Cookie Policy, DMCA / Copyright Complaints Policy, Data Processing Agreement (DPA), Payment and Billing Policy, Technical Support Policy, and Abuse Complaints Policy, constitutes part of the agreement between you and us. By registering an account, purchasing services, using a server, using an IP address, accessing the control panel, or continuing to use any of our services, you agree to comply with this Policy.
The purpose of this Policy is to protect our network, systems, IP address reputation, upstream providers, other customers, third-party rights holders, and the security of the public internet.
If you violate this Policy, we may, depending on the nature and severity of the violation, restrict, suspend, terminate, delete, block, null-route, refuse a refund, decline to continue providing service, or take other reasonable measures.
2. Basic Principles of Use
You must use our services in a lawful, proper, secure, and good-faith manner that does not harm others.
You may not use our services to engage in any of the following types of conduct:
- Violating any applicable law, regulation, government order, or regulatory requirement;
- Infringing the intellectual property, privacy, reputation, trade secrets, or other lawful rights of others;
- Endangering network security, system security, or data security;
- Interfering with, damaging, or abusing our network, servers, IP addresses, bandwidth, or other resources;
- Harming our reputation, our upstream provider relationships, our data center relationships, or our IP address reputation;
- Creating risk, harm, or interference to other users, third parties, or the public internet;
- Engaging in fraud, scams, spam, network attacks, malware, phishing, data theft, or other unlawful or non-compliant activities.
3. Prohibited Content and Conduct
You may not use our services to host, publish, transmit, store, distribute, link to, promote, or assist with the following content or conduct.
3.1 Illegal Content
It is prohibited to host, transmit, or distribute any content that violates applicable law, including but not limited to:
- Illegal goods or services;
- Illegal drugs, narcotics, or controlled substances;
- Illegal weapons, explosives, or related transaction information;
- Illegal gambling, illegal lotteries, or unlicensed betting services;
- Money laundering, financial fraud, illegal fundraising, or unlicensed financial services;
- Services designed to circumvent sanctions, export controls, or regulatory requirements;
- Any other unlawful, restricted, or prohibited content.
3.2 Child Sexual Abuse and Content Harmful to Minors
It is strictly prohibited to use our services to host, distribute, store, link to, or promote any child sexual abuse material, child exploitation content, content that grooms or solicits minors, or any content involving harm to minors.
Upon discovery, we may immediately terminate the service, preserve necessary evidence, and report to the relevant authorities, upstream providers, data centers, or law enforcement as required by applicable law.
3.3 Terrorism and Violent Extremist Content
It is prohibited to host, distribute, or promote content related to terrorism, violent extremism, unlawful violent organizations, recruitment, incitement to attack, weapons manufacturing, the commission of violent crimes, or material support for unlawful violence.
3.4 Infringing Content
You may not use our services to infringe the copyright, trademark, patent, trade secrets, likeness rights, privacy, reputation, or other lawful rights of any third party.
Prohibited content includes but is not limited to:
- Pirated software;
- Cracked software;
- Serial numbers, activation codes, or license-bypass tools;
- Unauthorized film, music, games, e-books, courses, or databases;
- Unauthorized streaming services;
- Brand-impersonation websites;
- Counterfeit-goods sales websites;
- Other infringing content.

4. Spam and Email Abuse
You may not use our services to send, forward, assist in sending, or support any spam, unsolicited bulk email, or email activity that violates anti-spam laws.
Prohibited conduct includes but is not limited to:
- Sending unsolicited commercial email;
- Sending marketing email in bulk without the recipient's express consent;
- Using purchased, scraped, leaked, or unlawfully obtained mailing lists;
- Mail bombing;
- Snowshoe spamming;
- Forging email headers;
- Deceptive sender information;
- Open mail relays;
- Sending phishing emails;
- Sending emails containing malicious links, malicious attachments, or fraudulent content;
- Email activity that causes an IP address, domain, or network to be blacklisted.
If you operate an email service, you must ensure that:
- Recipients have actively opted in;
- Emails contain a clear and effective unsubscribe mechanism;
- Email content is not deceptive;
- Sender identity is genuine;
- You comply with applicable email, privacy, and anti-spam laws;
- You do not harm our IP address or network reputation.
If email activity gives rise to complaints, blacklisting, upstream warnings, or damage to network reputation, we may restrict ports, suspend email sending, null-route the IP, suspend the service, or terminate the service.
5. Network Attacks and Security Abuse
It is strictly prohibited to use our services to conduct, assist, conceal, relay, or support any network attack, security abuse, or unauthorized access.
Prohibited conduct includes but is not limited to:
- DDoS attacks;
- DoS attacks;
- UDP floods, SYN floods, ICMP floods, or other flooding attacks;
- Reflection attacks and amplification attacks;
- Unauthorized port scanning;
- Unauthorized vulnerability scanning;
- Unauthorized penetration testing;
- Brute-force attacks;
- Credential-stuffing attacks;
- Password spraying;
- Credential stuffing;
- Unauthorized access to systems, accounts, databases, or networks;
- Exploiting vulnerabilities to break into third-party systems;
- Building, hosting, or controlling botnets;
- Hosting command-and-control servers;
- Launching or assisting attacks against third-party networks, servers, applications, or users.
Without the express authorization of the owner of the target system, you may not use our services to conduct security testing, scanning, or penetration testing.
Even if you claim a legitimate testing purpose, if the activity gives rise to complaints, abnormal traffic, upstream warnings, or network risk, we may still restrict, suspend, or terminate the service.
6. Malware and Harmful Programs
You may not use our services to host, distribute, run, download, control, or link to any malware or harmful programs.
Prohibited content includes but is not limited to:
- Viruses;
- Trojans;
- Worms;
- Ransomware;
- Backdoors;
- Rootkits;
- Downloaders;
- Loaders;
- Account-theft programs;
- Keyloggers;
- Spyware;
- Mining trojans;
- Exploit kits;
- Malicious scripts;
- Phishing kits;
- Command-and-control programs;
- Tools used to attack, intrude, bypass security, or steal data.
If your server is compromised and used to distribute malware, you remain responsible for cleanup, remediation, and security hardening.
7. Phishing, Fraud, and Impersonation
It is strictly prohibited to use our services to engage in phishing, fraud, impersonation, social engineering, or other deceptive conduct.
Prohibited conduct includes but is not limited to:
- Impersonating banks, exchanges, payment platforms, cloud providers, social platforms, or other institutions;
- Creating fake login pages;
- Collecting others' accounts, passwords, verification codes, keys, or payment information;
- Impersonating another person's identity;
- Fake shopping websites;
- Fake investment platforms;
- Fake customer-service or technical-support scams;
- Gift-card scams;
- Cryptocurrency scams;
- Refund scams;
- Phishing emails, phishing SMS, or phishing links;
- Other conduct that deceives users, steals information, or unlawfully profits.
We may immediately suspend or terminate the service upon discovering phishing, fraud, or impersonation, without prior notice.
8. Proxies, VPNs, Tor, and Anonymization Services
Without our prior written approval, you may not use our services to operate the following:
- Public proxies;
- Open proxies;
- SOCKS proxies;
- HTTP proxies;
- Public VPNs;
- Free VPNs;
- Tor exit nodes;
- Anonymous forwarding services;
- Traffic relay services;
- Tunneling services;
- Mass account-registration proxies;
- Other services that may conceal the identity of end users and give rise to abuse complaints.
Even with approval, you remain responsible for any abuse, complaints, attacks, spam, unlawful conduct, IP blacklisting, and upstream actions arising from such services.
If a proxy, VPN, Tor, or similar service gives rise to complaints, blacklisting, attacks, fraud, abuse, or legal risk, we may immediately restrict, suspend, or terminate the service.
9. Cryptocurrency and High-Resource-Consumption Activities
Without our written approval, you may not use our services for cryptocurrency mining or similar high-resource-consumption activities.
Prohibited or restricted conduct includes:
- CPU mining;
- GPU mining;
- Disk mining;
- Covert mining;
- Mining trojans;
- High-I/O tasks;
- Sustained full CPU load;
- Sustained full network load;
- Compute tasks that affect node stability;
- Resource usage that violates the product's intended use.
If your resource usage affects platform stability, other customers, upstream providers, or data centers, we may limit resources, throttle, suspend, or terminate the service.
10. High-Risk Services
The following services require our prior written approval before use:
- Public VPN services;
- Proxy services;
- Tor exit nodes;
- Bulk-email platforms;
- Email-marketing platforms;
- File-distribution platforms;
- File-sharing platforms;
- Video-streaming platforms;
- Network-security testing platforms;
- Scanning services;
- Stress-testing services;
- Crawler or data-scraping platforms;
- Cryptocurrency-related business;
- High-risk financial business;
- Game acceleration or traffic-forwarding services;
- Short-link platforms;
- Free hosting or free-space services;
- Other business prone to abuse complaints, attack traffic, copyright complaints, or blacklisting.
If you use the services to operate the above business without approval, we may suspend, restrict, or terminate the service. To request approval, please submit an explanation via Console → Tickets (https://wawanode.com/dashboard/tickets/new).
11. Restrictions on Nested Virtualization, Resource Reallocation, and Sub-Provisioning
Certain regions, nodes, data centers, routes, or products may, due to hardware architecture, virtualization platform, kernel limitations, upstream provider policy, data center rules, network configuration, or product design, not support or not guarantee support for nested virtualization, nested containerization, hardware virtualization extensions, or related features.
Unless the product page expressly states support, or you have obtained our prior written approval, you may not do any of the following with our services:
- Install or run Proxmox VE, VMware ESXi, Hyper-V, Xen, KVM, OpenVZ, LXC, LXD, Docker nested-virtualization platforms, or similar systems to re-partition, virtualize, or containerize server resources;
- Create additional VPS, containers, virtual machines, virtual hosts, or similar instances within a VPS, cloud server, or other virtualization product for use by third parties;
- Re-partition, resell, lease, sub-license, or provide server resources to others as dedicated servers, VPS, containers, proxy nodes, VPN nodes, virtual hosts, or other infrastructure services;
- Use nested virtualization, bridged networking, TUN/TAP, GRE, IPIP, VXLAN, BGP, additional routing, MAC-address spoofing, IP forwarding, or similar techniques to circumvent product limits, network limits, IP limits, or risk-control rules;
- Use technical means to circumvent limits on CPU, memory, disk, I/O, bandwidth, connection count, ports, IP addresses, or other resources;
- Cause spam, attacks, phishing, malware, proxy abuse, copyright complaints, blacklisting, fraud, or other abuse issues through sub-provisioning, resource reallocation, or end-user activity.
We do not guarantee that any product supports VT-x, AMD-V, nested virtualization, KVM modules, LXC/LXD, TUN/TAP, bridged networking, custom kernels, kernel-module loading, virtual NICs, additional MAC addresses, additional IP routing, or similar features. Even if certain features are available at a given time, this does not mean we commit to continuing to provide or support them.
If you need to run Proxmox VE, LXC, LXD, KVM, ESXi, Hyper-V, or similar virtualization, containerization, or resource-reallocation business, you should confirm whether the product supports it before purchase and obtain our express written permission. If you purchase, install, configure, or use such features without prior confirmation or approval, you bear the associated risk.
If we find that you have engaged in nested virtualization, resource re-partitioning, reselling, subleasing, sub-licensing, or providing infrastructure services to third parties without approval, we may, depending on the circumstances, take the following measures:
- Require you to stop the relevant conduct;
- Require you to migrate or delete the relevant virtual machines, containers, or end-user services;
- Restrict networking, ports, routing, TUN/TAP, bridging, or related features;
- Restrict, suspend, or terminate the relevant service;
- Reclaim IP addresses;
- Decline to continue providing service;
- Refuse a refund;
- Take other necessary measures based on abuse, complaints, or upstream requirements.
You bear any complaints, abuse, data loss, business interruption, network restrictions, service termination, IP blacklisting, legal liability, or other losses arising from unapproved nested virtualization, resource reallocation, sub-provisioning, or third-party use.
12. Resource Usage Limits
You should make reasonable use of CPU, memory, disk, storage, I/O, bandwidth, IP addresses, network ports, and other resources.
The following conduct may be deemed resource abuse:
- Sustained full CPU load;
- Sustained high memory usage that affects node stability;
- Abnormal disk I/O;
- Large volumes of small-packet traffic;
- Sustained high PPS;
- Abnormal numbers of network connections;
- Large numbers of concurrent connections;
- Resource usage that affects other customers;
- Circumventing plan limits;
- Using scripts or programs to maliciously consume resources;
- Use that exceeds the product's reasonable purpose;
- Conduct that degrades the performance of systems, nodes, networks, or storage.
If we consider your resource usage abnormal or detrimental to service stability, we may restrict, migrate, throttle, suspend, or terminate the service.
13. IP Address Usage and Reputation
You should use the IP addresses allocated to you lawfully, reasonably, and prudently.
Prohibited conduct includes:
- Using IP addresses to send spam;
- Using IP addresses to conduct attacks;
- Using IP addresses to run phishing sites;
- Using IP addresses to host malware;
- Causing IP addresses to be blacklisted;
- Using IP addresses for fraud, proxy abuse, or account-registration abuse;
- Selling, leasing, transferring, or sub-licensing IP addresses;
- Announcing, routing, or transferring IP addresses without authorization;
- Violating upstream provider or registry rules.
If you cause damage to IP address reputation, blacklisting, complaints, or upstream restrictions, we may require remediation, charge handling fees, reclaim the IP, suspend, or terminate the service.
14. Scanning, Testing, and Research Activities
Without the express authorization of both us and the owner of the target system, you may not use our services to conduct any scanning, testing, or research activity.
Restricted activities include:
- Port scanning;
- Vulnerability scanning;
- Fingerprinting;
- Automated probing;
- Brute-force testing;
- Web scanning;
- Network mapping;
- Penetration testing;
- Stress testing;
- Security-research traffic.
Even if you consider the activity to be security research, if it gives rise to complaints, abnormal traffic, attack signatures, or upstream alerts, we may still restrict or suspend the service.
15. Adult Content
Unless otherwise permitted by the product page or a written agreement, you may not use our services to host adult content that is unlawful, non-consensual, exploitative, involves minors, or infringes the rights of others.
Even where adult content is legal in certain jurisdictions, if it gives rise to substantial complaints, payment risk, upstream provider restrictions, data center restrictions, or legal risk, we may still refuse, restrict, suspend, or terminate the relevant service.
Any material involving minors, non-consent, covert recording, extortion, human trafficking, sexual exploitation, or unlawful content is strictly prohibited.
16. Data Scraping and Automated Access
You may not use our services to conduct data scraping, crawling, automated registration, bulk requests, or similar activities that violate the law, third-party terms, or cause network abuse.
Prohibited conduct includes but is not limited to:
- Bypassing CAPTCHAs;
- Bulk account registration;
- Scraping restricted data;
- Collecting personal information;
- Scraping content behind a login;
- Bypassing access restrictions;
- Causing abnormal load on a target website;
- Violating a target website's terms of service;
- Using proxy pools to evade detection;
- Engaging in traffic inflation, fake orders, fake reviews, or other platform-cheating conduct.
17. Fraud, Payment Abuse, and Account Abuse
You may not engage in any fraud related to accounts, orders, or payments.
Prohibited conduct includes:
- Registering with a false identity;
- Using false contact information;
- Using stolen payment methods;
- Using another person's payment account, card, cryptocurrency wallet, or other payment method without authorization;
- Malicious chargebacks;
- Circumventing risk controls;
- Creating multiple accounts to bypass limits;
- Using proxies, VPNs, or false information to hide genuine risk;
- Reselling accounts;
- Assisting others in evading bans, restrictions, or review.

18. End-User Responsibility
If you provide, resell, allocate, or open up our services to your customers, users, employees, contractors, or other third parties, you remain responsible for their conduct.
You must ensure that your end users comply with this Policy, the Terms of Service, and other applicable rules.
If your end user violates this Policy, we may directly restrict, suspend, or terminate the relevant service provided to you.
19. Handling of Abuse Complaints
We may receive abuse complaints from the following sources:
- Third-party rights holders;
- Network-security organizations;
- Upstream providers;
- Data centers;
- Blacklist maintainers;
- Anti-spam organizations;
- Law enforcement;
- Regulators;
- Affected networks, platforms, or individuals;
- Other reasonable complaint sources.
Upon receiving a complaint or detecting an anomaly, we may, depending on the circumstances, take the following measures:
- Forward the complaint to you;
- Require you to explain the situation;
- Require you to remediate within a deadline;
- Require you to provide evidence;
- Restrict ports;
- Restrict bandwidth;
- Block specific traffic;
- Null-route the IP;
- Suspend the service;
- Delete or require deletion of the relevant content;
- Terminate the service;
- Cooperate with upstream providers, data centers, rights holders, or law enforcement by providing necessary information.

20. Complaint-Response Requirements
You must respond promptly to abuse notices, security notices, complaint notices, or remediation requests we send.
Unless otherwise stated in the notice, you should generally act within the following timeframes:
- Serious security incidents, phishing, malware, DDoS, child-safety issues: immediately;
- Spam, scanning, blacklisting, proxy abuse: within 24 hours;
- General copyright, trademark, content, or compliance complaints: within 48 hours;
- Other issues: within the deadline we specify.
If you fail to respond promptly, fail to complete remediation, repeatedly violate, or the complaint is serious, we may suspend or terminate the service.
21. Emergency Action
In the following circumstances, we may take immediate action without prior notice:
- Involving child sexual abuse material;
- Involving phishing, fraud, or credential theft;
- Involving malware, ransomware, or botnets;
- Involving DDoS, attack traffic, or serious network interference;
- Involving large-scale spam;
- Involving urgent requests from law enforcement, courts, regulators, or upstream providers;
- Involving major damage to IP reputation;
- Involving imminent risk of disconnection by a data center or upstream provider;
- Involving serious impact on other customers or third parties;
- Other circumstances where we consider immediate action necessary to protect the network, security, our legal position, or third-party rights.
Emergency measures may include suspension, disconnection, port blocking, null-routing, deletion, restriction, termination, or refusal to continue providing service.
22. Repeat Violations
If your account, service, IP address, or end users repeatedly give rise to complaints, violations, blacklisting, attacks, spam, phishing, malware, copyright complaints, or other abuse issues, we may deem this a repeat violation.
For repeat violations, we may take the following measures:
- Require stricter identity verification;
- Require a business explanation;
- Restrict certain features;
- Restrict email or specific ports;
- Reclaim IP addresses;
- Decline to add new services;
- Terminate the service early;
- Permanently close the account;
- Refuse a refund;
- Decline future service.
23. Monitoring and Investigation
We do not proactively review all user content, but we reserve the right to investigate in the following circumstances:
- Upon receiving a complaint;
- Upon detecting abnormal traffic;
- Upon triggering a security alert;
- Upon discovering blacklisting or reputation issues;
- Upon receiving notice from an upstream provider or data center;
- Upon receiving a legal, regulatory, or law-enforcement request;
- Upon suspecting a violation of this Policy;
- As necessary to protect the network, services, customers, or third parties.
Investigation may include reviewing account information, network-traffic characteristics, system logs, abuse evidence, public content, complaint materials, and necessary server-related information. Our handling of personal data is governed by the Privacy Policy and, where applicable, the Data Processing Agreement (DPA).
24. Service Restrictions and Enforcement Measures
If you violate this Policy, we may, depending on the circumstances, take one or more of the following measures:
- Warning;
- Requiring remediation;
- Requiring an explanation;
- Restricting control-panel features;
- Restricting bandwidth;
- Restricting ports;
- Blocking specific protocols;
- Null-routing the IP;
- Suspending the service;
- Deleting or requiring deletion of content;
- Reclaiming IP addresses;
- Terminating the service;
- Closing the account;
- Refusing a refund;
- Declining future orders;
- Cooperating with upstream providers, data centers, rights holders, or law enforcement by providing necessary information.
Whether and which measure we take is at our discretion, based on the nature, severity, and risk of the violation, the complaint record, and the business impact.
25. Impact on Refunds
Where a service is suspended, restricted, terminated, deleted, blocked, null-routed, or the account closed due to a violation of this Policy, the relevant fees are generally non-refundable.
This includes but is not limited to:
- Service subscription fees;
- Dedicated server fees;
- VPS / cloud server fees;
- IP address fees;
- Setup fees;
- Software license fees;
- Bandwidth fees;
- Overage traffic fees;
- Custom service fees;
- Fees incurred from abuse handling.

26. Legal Cooperation
If we receive a court order, subpoena, law-enforcement request, regulatory requirement, upstream provider request, or other lawful request, we may, in accordance with applicable law and the circumstances, disclose necessary information, preserve evidence, restrict the service, or terminate the service.
We may also proactively report serious unlawful, security, or abuse incidents where reasonably necessary to protect us, our customers, our suppliers, third parties, or the public.
27. Your Remediation Obligations
When we notify you of a violation, complaint, security issue, or abuse, you should immediately take the necessary measures, including but not limited to:
- Stopping the violating conduct;
- Deleting unlawful or non-compliant content;
- Fixing vulnerabilities;
- Cleaning up malware;
- Stopping spam;
- Closing abused accounts;
- Restricting end users;
- Changing passwords and keys;
- Hardening system security;
- Submitting a remediation statement or evidence.
If you are unable or unwilling to remediate, we may suspend or terminate the service.
28. Changes to This Policy
We may update this Policy from time to time to reflect changes in law, technology, network security, supplier requirements, our business, or abuse trends.
The updated Policy will be published on the website with a new effective date. Your continued use of the services after the update constitutes acceptance of the updated Policy.
If you do not agree to the updated Policy, you should stop using the services and cancel the relevant services.

30. Information to Include in an Abuse Report
To help us handle an abuse complaint, please include the following information in your report where possible:

- Logs, screenshots, email headers, samples, links, or other evidence;
- The name or organization of the complainant;
- The complainant's contact information;
- Any other information that helps locate and resolve the issue.
We will handle the report based on its content, the evidence, the severity, legal requirements, and upstream requirements, but we do not guarantee that we will disclose the specific outcome to the complainant.
31. Governing Law and Dispute Resolution
This Policy, and any dispute arising out of or relating to this Policy or your use of the services between you and WawaCloud Inc., are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict-of-laws rules.
You and we agree that any dispute, action, or proceeding arising out of or relating to this Policy or the services shall be brought before the courts of competent jurisdiction located in Ontario, Canada, and you irrevocably submit to the jurisdiction of those courts.
32. Language
This English version is the governing version. Where a translated version conflicts with or differs from this English version, the English version shall prevail, unless applicable law mandates otherwise.
